1. Website Owner Identification
This website MindReset (hereinafter, the “Site”) is owned by PAO INVEST CORP doing business as Arboleda Coaching Corp., a company incorporated under the laws of the State of Florida, United States of America, with its registered office at 7500 SW 138 St, Palmetto Bay, FL 33158, USA and contact e-mail info@mindresetretreat.com (hereinafter, the “Owner”). The MindReset brand is commercially operated by the Owner in its capacity as service provider.
2. Purpose and Scope of Application
Access to, browsing and use of the Site confer the status of User and imply full and unreserved acceptance of these General Terms and Conditions of Use (hereinafter, the “T&C”). If the User disagrees with any part of them, the User must refrain from using the Site.
These T&C govern access to and use of the Site, as well as the contracting of the digital and in-person services offered by the Owner (retreats, workshops, downloadable content, etc.).
3. Conditions of Access and Use
3.1. Lawful use. The User undertakes to use the Site and its services in accordance with the law, moral standards, public order and these T&C, and to refrain from any acts that may damage, disable, overload or impair the Site or impede its normal use by other Users.
3.2. Minimum age. The Site is intended exclusively for individuals aged 18 years or older. By using the Site, the User represents and warrants that he/she meets this minimum age requirement.
3.3. Accuracy of information. The User guarantees the truthfulness, accuracy and timeliness of all information provided through the Site.
4. Payment Processing
4.1. Payment gateway. All payments for the products and services offered on the Site are securely processed via Stripe Payments Europe, Limited or its affiliates, with the Owner acting as the registered merchant and recipient of the funds.
4.2. Currency and charges. Unless otherwise indicated, all amounts are displayed and charged in euros (EUR). The User may incur currency-conversion fees charged by his/her bank, for which the Owner is not responsible.
4.3. Taxes. Prices include, where legally applicable, Value Added Tax (VAT) or other taxes according to the User’s place of residence.
4.4. Cancellations and refunds (general). Reservation, cancellation and refund policies are set out in the specific conditions of each product or service and are deemed to be incorporated into these T&C.
4.5. Cancellation Policy (retreats). Notwithstanding the foregoing, for Retreat bookings the following specific cancellation terms apply to Confirmed Participants:

i. More than ninety (90) days before the start date of the Retreat: 50% refund to the Confirmed Participant (less a USD $500 administrative fee to Arboleda Coaching).

ii. Between sixty (60) and ninety (90) days before the start date of the Retreat: 25% refund (less a USD $500 administrative fee to Arboleda Coaching).

iii. Fewer than sixty (60) days before the start date of the Retreat: no refund.
For clarity, the administrative fee indicated above is denominated in USD and will be deducted from the applicable refund amount. Any payment-processor fees, currency-conversion costs or bank charges are non-refundable and are borne by the User.
5. Intellectual and Industrial Property
All contents of the Site (texts, graphics, logos, trade names, source code, software, designs, photographs, videos, audios and other elements) are the exclusive property of the Owner or are lawfully used under licence and are protected by international intellectual and industrial property regulations. Any reproduction, distribution, public communication, making available or transformation, in whole or in part, of said contents without the prior, express and written authorisation of the Owner is strictly prohibited.
6. Third-Party Links
The Site may contain links to third-party websites. The Owner accepts no responsibility whatsoever for the content, operation or practices of such external websites. The inclusion of any link does not imply any relationship, recommendation or approval by the Owner.
7. Disclaimer of Warranties and Liability
7.1. Availability. The Owner does not warrant the availability, continuity or infallibility of the Site, which may be temporarily suspended for technical reasons, maintenance or force majeure.
7.2. Limitation of liability. Use of the Site is at the User’s sole responsibility. The Owner shall not be liable for any direct, indirect, incidental, special or consequential damages arising from access to or use of the Site or the content hosted therein.
7.3. Use of content. The content of the Site is provided for informational and educational purposes only. No part of it constitutes medical, psychological or legal advice or replaces consultation with duly licensed professionals.
8. Data Protection and Marketing Communications
8.1. Data processing. The Owner will process Users’ personal data in accordance with the Privacy Policy available on the Site.
8.2. Marketing purpose. The User is informed that his/her data may be shared with marketing partners and providers (communication agencies, e-mail automation platforms, social-media managers) solely for the purpose of sending personalised communications about MindReset products and services.
8.3. User rights. The User may exercise at any time his/her rights of access, rectification, erasure, objection, restriction and portability, as well as withdraw consent, as detailed in the Privacy Policy.
9. Amendments
The Owner reserves the right to modify these T&C at any time. Updated versions will be published on the Site indicating the effective date. Continued use of the Site after such publication constitutes acceptance of the modifications.
10. Severability
If any clause of these T&C is declared null, invalid or unenforceable by a competent authority, such declaration shall not affect the validity of the remaining clauses, which shall remain in full force and effect.
11. Governing Law and Jurisdiction
These T&C shall be governed by and construed in accordance with Spanish law. The parties, expressly waiving any other jurisdiction to which they may be entitled, submit to the jurisdiction of the Courts and Tribunals of the city of Madrid (Spain), unless consumer-protection regulations establish a different mandatory forum.
